Case study: Restorative justice - Fred

This case study involves a crime for which restorative justice is being considered to deal with the harm caused.

'Restorative justice' involves trying to respond to the impact of a crime and trying to avoid using punishment of a criminal as the only way of dealing with crime in local communities. Punishments do not always work for offenders, or do anything positive for victims. Restorative justice tries to build understanding between the offender and the victim to some extent, by getting each to recognise that the other is a person with feelings too, and by getting the criminal to do something by way of 'saying sorry' and put right the harm they have caused.

Sometimes a restorative justice solution can be used instead of, rather than as a form of, punishment, avoiding the need for a trial.
